Famous Mark Case Without Local Registration
Protecting a famous global mark in Saudi Arabia despite no local registration — based on the famous-marks principle.
Challenge
A famous global brand not yet registered in Saudi Arabia. An opportunistic party registered the mark in his name and demanded a large sum from the global owner to release it.
Approach
We filed a cancellation petition against the second registration, relying on protection of famous marks even without local registration (per Article 6bis of the Paris Convention). We supported with international fame evidence.
Outcome
The opportunistic registration was canceled. Our client subsequently registered the mark officially in Saudi Arabia. The ruling set an important precedent for famous-marks protection.
