How to Tell If Your Trademark Is Being Infringed: 5 Warning Signs

Trademark infringement may occur in indirect ways that brand owners don't notice. When any of these signs appear, act immediately — because delay accumulates damages and weakens your legal position.

1. Sudden Sales Decline Without Apparent Cause

If your sales drop in a specific region without strategic change, monitor that market. A competitor may be using a similar mark to divert your customers.

2. Customer Complaints About a Product You Didn't Sell

'I bought your product and it was poor quality' — then you discover you didn't sell it. This is a very strong signal that a counterfeit product is being attributed to you.

3. Your Name or Logo Appearing in Online Stores Without Permission

Open Amazon, Noon, Instagram and search your brand name. If you find listings you don't own — that's infringement. Some sellers use your name to market a completely different product.

4. Similar Domain Name Registrations

If you discover a domain like yourbrand-official.sa or yourbrand-shop.com you don't own, that's an exploitation attempt. It may redirect visitors to counterfeit products or phishing pages.

5. Similar New Registration Applications

If you receive a notice (from a monitoring service) or see in the Authority's bulletin an application for a mark similar to yours, act immediately. The opposition period is limited — after which registration becomes final.

What to Do Upon Discovering Infringement?

First step: document evidence (screenshots, photos, samples, invoices if possible). Second step: contact a specialized legal office. Do not contact the infringer before legal consultation — because your message may be used against you. At Rights, we manage the entire file from documentation to judgment.
