Industrial Design Protection Under Saudi Law

The most overlooked area of IP. Companies spend millions designing unique products, then leave them legally exposed. Industrial design is cheap, strong protection — if you know when to use it.

What Does Industrial Design Protect?

The new visual shape of an industrial product. Includes: packaging shape, furniture design, fabric pattern, car shape, electronics design.

Does not protect function. A competitor can build a device performing the same function in a different shape without infringing.

Registration Requirements

Novelty: the design has not been publicly disclosed before filing.

Originality: not a copy of another design.

Individual character: clearly differs from known designs in the sector.

Pre-filing disclosure destroys novelty. Exception: a 6-month grace period for disclosure by the right holder.

Procedure in Saudi Arabia

Filed with SAIP with design images from multiple angles (if 3D).

Formal and substantive examination. Duration: 6–12 months.

Fees: SAR 1,500 filing + SAR 3,000 issuance = SAR 4,500 total per design.

Protection lasts 10 years from filing, extendable for an additional 5 years (15 total).

International Application via the Hague Agreement

Saudi Arabia joined the Hague Agreement in 2022. Allows registration in 96 member countries with one application.

Highly useful for Saudi fashion designers, furniture makers, and electronics companies looking to export.

Industrial Design vs. Trademark

Design protects shape for a limited time (15 years max) and does not require commercial-source identification.

Trademark may protect the same shape (trade dress) indefinitely, renewable, but requires the shape to "identify" a commercial source in consumer perception.

Smart strategy: file an industrial design immediately (fast, cheap), then build brand reputation to file trade dress later.

Furniture: chair, table, and lighting designs.

Packaging: bottle and box shapes, visual product design.

Electronics: device designs, GUI.
